A $300 deposit is required by credit card or bank card for the use of the shipping container. Semen will be shipped to the veterinary clinic chosen and named above, by purchaser. Transportation expense is $200 in the Continental U.S. and is payable in advance by purchaser to seller, and will be via Federal Express or similar service. Purchaser agrees to return shipping container via prepaid Federal Express within 24 hours of its receipt, along with signed form acknowledging receipt of transported frozen semen. If Tank is not shipped for return within 24 hours, purchaser agrees to pay $30 per day delinquent fee until tank is returned. Any loss or damage to the shipping tank after arrival, will be the responsibility of the purchaser. Compensation for loss or damage, will be charged and/or billed to the purchaser for a sum of up to $750 US dollars. Seller takes no responsibility for damage, loss, or injury resulting from the handling of liquid nitrogen. The parties agree herein that Wingfield Farms offers frozen semen import as a service to other breeders and make no claims as to the viability, availability, fertility, or freedom from any disease of any of the semen we have imported. There is no breeding contract and no live foal guarantee. Prices are subject to change and all sales are final. Full protocol regarding the storage and use of the semen will be provided by the owners of the stallions and will be included with semen straws. For breeding certificates to be issued, confirmation of pregnancy should be given to Wingfield Farms and notification of requested registry so that proper forms can be filed. Upon foaling, it is the buyers responsibility to notify Wingfield Farms so that a report can be filed. Each respective registry will then require their own fees, forms, DNA typing of foal and mare, and any other necessary requirements for registration. Wingfield Farms will provide the Stallion service report to the registry upon proper notification. This contract shall be interpreted in accordance with the laws of the State of Nevada, and its validity and administration shall be governed by said laws. This contract may not be assigned or transferred by the purchaser. This contract, signed by the respective parties, and those documents referred to herein, which are hereby incorporated by reference, constitute the entire agreement between the parties and same may not be amended or modified. In the event of a breach of this contract or any part thereof, purchaser agrees to pay any and all attorney fees or other expenses of any kind incurred, or which may be incurred on behalf of the seller in the enforcement of this agreement.
